END USER LICENCE AGREEMENT (EULA) FOR DIGITAL SHEET MUSIC

IMPORTANT, PLEASE READ CAREFULLY: This End User Licence Agreement (“Agreement”) is a legal agreement between you (the “Licensee” or “User”) and Steven Osborne (“Licensor”) for the digital sheet music file(s) accompanying this Agreement, which includes computer files, printed media, and online or electronic documentation (“Sheet Music”).

By purchasing, downloading, copying, or otherwise using the Sheet Music, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not download or use the Sheet Music.

1. GRANT OF LICENCE
The Licensor grants you a non-exclusive, non-transferable, revocable, worldwide licence to use the Sheet Music strictly in accordance with the terms of this Agreement.

2. PERMITTED USES (WHAT YOU CAN DO)
Under this licence, you are permitted to:

  • Print copies: Print one physical copy of the Sheet Music solely for your personal, educational, or private practice use.

  • Digital display: View the Sheet Music on your personal electronic devices (for example, a tablet, computer, smartphone or e-reader) for your own personal use.

  • Live performance: Perform the piece live in non-commercial settings, or in commercial settings provided that the venue or event holds the appropriate public performance licences (for example, through PRS for Music, ASCAP, BMI, or the equivalent performing rights organisation in your country).

3. RESTRICTIONS (WHAT YOU CANNOT DO)
You may not do any of the following without the express written permission of the Licensor:

  • Distribution: Share, email, transfer, or distribute the digital file to any other individual, ensemble, or organisation.

  • Duplication: Print more copies than permitted in Section 2, or make copies of printed versions for other musicians.

  • Commercial resale: Sell, lease, rent, license, or sub-license the Sheet Music or any printed copies of it.

  • Derivative works: Arrange, adapt, edit, remix, or alter the musical composition or notation to create a new derivative work.

  • Digital hosting: Upload the file to any public or private server, cloud storage, file-sharing site, website, or social media platform where others can access it.

4. INTELLECTUAL PROPERTY RIGHTS
The Sheet Music is licensed, not sold. All title, copyright, and intellectual property rights in and to the Sheet Music (including but not limited to the musical composition, lyrics, arrangement, and typography) are owned exclusively by Steven Osborne. This Agreement does not grant you any ownership rights.

5. TERMINATION
This Agreement remains in effect until terminated. Your rights under this licence will end automatically, without notice, if you fail to comply with any of its terms. On termination, you must destroy all digital and physical copies of the Sheet Music in your possession.

6. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
The Sheet Music is provided “as is” without warranty of any kind. To the maximum extent permitted by law, the Licensor disclaims all warranties, express or implied, and shall not be liable for any damages arising out of the use of, or inability to use, the Sheet Music. Nothing in this Agreement affects your statutory rights as a consumer.

7. GOVERNING LAW
This Agreement is governed by and shall be construed in accordance with the law of Scotland, and the courts of Scotland shall have jurisdiction over any dispute arising from it.
